Terms and Conditions of www.polohaus.com
1. Purpose of Terms of Conditions
Purpose of this Terms & Conditions (this “Agreement”) is to set out the rights, the obligations and other necessary matters between any individual who make the purchases at www.polohaus.com and the seller.
In these Terms and Conditions, the following terms shall have the following respective meanings:
2.1 “Seller” means BRG Polo Haus Sdn Bhd (126749-X) (“POLO HAUS”) who sells the Product(s) in this Website;
2.2 “Customer” means any individual who places an Order on the Website;
2.3 “Member” means any individual who has registered himself/ herself as a member on the Website;
2.4 “Account” means the account that you will need to register on the Website if you would like to submit an Order as a member;
2.5 “Non-Member” means any individual who submit an Order as a guest without having registered himself/ herself as a member on the Website;
2.6 “Business Day” means any day other than Saturday, Sunday, a national public holiday or State (at Seller’s working premises) public holiday in Selangor;
2.7 “Order” means the order submitted by customer on the Website to purchase a Product from the seller;
2.8 “Contract” means any Order of a Product(s) which we accept in accordance with Clause 4.2 – “Placing Order” below;
2.9 “Website” means www.polohaus.com;
2.10 “Product(s) means the products that are offering to be sold at the Website.
To place an Order with POLO HAUS, you must be eighteen (18) years of age or above.
4. Terms of Sale
a) To place an Order, Customer can either register with us by creating an Account on the Website or purchase as a guest. Customer must fill in the information which is accurate and true.
b) Customer shall not misuse the Website by creating multiple user accounts.
4.2 Placing Order
a) The information set out in the Terms and Conditions and the details contained on this Website do not constitute an offer for sale but rather an invitation to treat. No Contract is formed between customer and the Seller until the Seller ships the Product(s) to the Customer.
b) Customer will receive an acknowledgment via email from us after placing an Order.
4.3 Price and Payment
a) All prices displayed on the Website are inclusive of Goods and Services Tax (“GST”) and are in Ringgit Malaysia. Delivery costs will be charged where applicable, such additional charges are clearly displayed upon checkout.
b) Whilst we make our best efforts to ensure that all details, descriptions and prices which appear on the Website are accurate, there may be instances where errors may occur. If we discover an error in the price of any Product(s) which you have ordered we will inform you of this as soon as possible and give you the option of re-confirming your Order at the correct price or cancelling it. We are under no obligation to fulfill your Order if the price listed on the Website is incorrect.
c) You can make the payment through our payment partners either by credit card, debit card or FPX online transfer.
d) If you intend to use any e-voucher or online promotional voucher code, the e-voucher or the online promotional voucher code must be entered at the checkout page after you have confirmed the Order.
e) Upon authorisation of the payment, you confirmed that you have the authority to use the credit / debit card or that you are the legitimate holder of the e-voucher to proceed with the payment of the Product(s).
5.1 We aim to deliver the Product(s) to Customer within 3 to 5 business days.
5.2 We shall notify Customer if we are unable to meet our standard delivery period, but, to the extent that is permitted by law, we shall not be liable to Customer for any losses, liabilities, costs, damages, charges or expenses arising out of the late delivery.
5.3 We currently only ship within Malaysia. We are sorry that we do not ship any Product(s) to other countries.
5.4 Upon delivery of the Product(s), you are required to acknowledge receipt of the Product(s) by signing on the Delivery Order. All risk in the Product(s) shall pass to you upon delivery.
6. Cancellation by Customer (Non-Faulty Products)
It is not possible to cancel or change your Order once you have placed an Order on the Website, as we will start to process your Order immediately once the Order is confirmed. You may refer to Clause 7 – “Returns and Exchange Policy” for return or exchange of the Product(s).
7. Returns and Exchanges Policy
7.1 If you are not satisfied with your purchase, you may return the Product(s) to us within 21 days from the date of purchase.
If the Product(s) is unfit, we regret to inform that it is not possible to exchange the order. You may return the Product(s) and we will refund through voucher for you to place a new order with us.
7.2 All returned Product(s) must be in its original purchase condition, including the original product packaging with all tags attached, unaltered and unwashed. All packaging must be unmarked and not defective in any manner.
7.3 Before you return the Product(s), please send an email to us at firstname.lastname@example.org with the following information within 21 days from the date of purchase:-
(i) Return Reason;
(iii) Attach the copy of the Tax Invoice issued by us as we need to determine the item code and the description of the Products
(Please note that there will be no cash refund for return. The refund will be made in the form of e-voucher which you may utilise for your next purchase. The e-voucher has a validity period of 12 months and it is non-extendable.)
7.4 After we receive your request for return via email, we will send you an acknowledgment via email.
7.5 Please return the Product(s) in its original packaging together with the Tax Invoice you received along with your order of the Product(s) and courier them to the following address:

7.6 Upon receiving and confirming that the returned Product(s) is in its original condition, we will issue the e-voucher code and send it via email to the email address that you registered when you placed the Order. The return process may take up to 21 business days from the date the Product(s) is returned to us.
We reserve the right to amend these Terms and Conditions at any time. All amendments to these Terms and Conditions will be posted online. However, the continued use of this Website by you shall mean that you have accepted the new Terms and Conditions.
When you submit an Order in the Website, you are required to acknowledge and agree that you agree to the Terms and Conditions set-out herein or any variation thereof.
